IRS whistleblower Gary Shapley is standing by his claims that the U.S. attorney investigation of Hunter Biden, son of President Joe Biden, was blocked from bringing charges outside of Delaware. The IRS investigator further alleged that the president’s son received preferential treatment in a case probing his failure to pay taxes that resulted in a plea agreement earlier this month.

It is expected to be approved, and the younger Biden will avoid jail time.

The probe of Hunter Biden dated back to the Trump administration, has said he was repeatedly prevented from taking steps that might have been considered routine in similar cases. He said the investigation was “slow-walked” by the U.S. Attorney For Delaware David Weiss, a Trump appointee.

“We have to make sure as a special agent for IRS Criminal Investigation that we treat every single person exactly the same,” Gary Shapley, a 14-year veteran of the agency, spoke exclusively to CBS News chief investigative correspondent Jim Axelrod on Tuesday. “And that just simply didn’t happen here.”

Shapley, who testified before the House Ways and Means Committee, has become a key basis for Republicans arguing the United States Department of Justice (DoJ) improperly handled the case. Hunter Biden has since paid back taxes on more than $200,000 of income tax for the 2017 and 2018 tax years. However, Shapley has alleged that some of the most serious tax misconduct took place beforehand and that the younger Biden could owe a total of $2.2 million in taxes from 2014 through 2019.

The whistleblower has also said that the U.S. Attorney For Delaware’s office claimed it was unable to bring charges in Washington, D.C., where Shapely said he believes they would have the strongest case.

“There were really earth-shaking statements made by David Weiss that really brought to light some of my previous concerns. And the first one was that he is not the deciding person on whether or not charges are filed. It was just shocking to me,” Shapley added. “I documented exactly what happened. And it doesn’t seem to match what the attorney general or the U.S. attorney are saying today.”

Hunter Avoids Jail

Hunter Biden’s plea deal includes an acknowledgment that his past drug use was a contributing factor in his gun crime, and he will enter into a pretrial diversion agreement on that charge, according to the filing. Hunter Biden admitted to the drug use in his memoir “Beautiful Things,” published by an imprint of Simon & Schuster. A failed drug test in 2014 led to his dismissal from the United States Navy Reserve just one month after he was granted a position, despite being 43 years old at the time and an admitted addict. There were reportedly efforts made to conceal his dismissal.

Under the terms of the deal, Hunter Biden must remain drug-free for two years and he must not commit additional crimes. If he fulfills this successfully, the gun count would be dismissed. It has been noted this does not amount to a guilty plea.

A federal judge has yet to approve the deal, but currently, it is expected that will be the case. A hearing has been scheduled on July 26 before Judge Maryellen Noreika at the federal courthouse in Wilmington, Delaware.

Wait, There’s More

Shapley also told CBS News that the five-year investigation uncovered conduct that he says could have resulted in additional charges for the president’s son.

“Based on my experience, if this was a small business owner or any other non-connected individual, they would have been charged with felony counts,” Shapley said.

Shapley told CBS News that Hunter Biden reportedly wrote off as business expenses the money he paid for “prostitutes, sex club memberships, travel for the prostitutes, hotel rooms for purported drug dealers, no show employees.”

The allegations seem believable given Hunter Biden’s history.

A 2019 DNA test found that he was the “biological and legal father” of a child born to exotic dancer, Lunden Alexis Roberts – but Hunter claimed in his memoir he had no recollection of any sexual encounter with her. Though that already could only be described as despicable, it should be added that during that same period, Hunter Biden began an affair with his brother’s widow, Hallie Biden, which lasted for two years.

Hunter Biden is now seeking to reduce child support of $20,000 per month for the girl who turns 5 in August.
