Could Joe Biden Be Impeached for the Border Crisis?

President Joe Biden is duty-bound to use all measures to repel this ongoing invasion and strengthen America’s porous borders. So why won’t he?

Can Joe Biden Be Impeached for His Border Crisis? – As we’ve learned throughout Donald J. Trump’s controversial presidency, impeachment is less of a legal procedure and more of a political process.

Essentially, any president can be impeached as long as there are enough votes in Congress. 

Watching the crisis unfold along America’s southwestern border, understanding that most of it is entirely the result of President Joe Biden’s abysmal border and immigration policies, many have questioned whether the forty-sixth president could—or should—be impeached for presiding over such a disaster.

Certainly, the House Republicans are already investigating President Biden for any potential linkages to the suspected illicit international influence-peddling scheme that his son, Hunter, had managed for decades. 

Should links between Hunter’s corrupt schemes to President Biden be found by House Republican investigators, Mr. Biden will likely be impeached.

Joe Biden and The Guarantee Clause

Yet, the Hunter Biden is viewed by at least half the country as a Republican sideshow (in much the same way the Democrats viewed the horrific events of Benghazi, Libya 2012). 

The border, however, impacts the entire country. 

It represents a catastrophic failure of presidential leadership that will have long-lasting, negative impacts on the American economy, on our social cohesion, and it will also harm the illegal immigrants themselves, who are being abused and exploited.

The president has a duty, under Article IV, Section 4 of the U.S. Constitution (what’s known colloquially as the “Guarantee Clause”) to protect all states from an invasion. 

The Left, being humorless, as well as disingenuous in that they take everything literally so as to prove their point, insist that the 10,000-per-day illegal immigrants that are being detained by US border officials do not represent an invasion. 

In their mind—and in the minds of most Americans—an invasion is when a rival military, armed-to-the-teeth, attacks our country and enters our territory. 

Sadly, however, that’s not the only definition of an invasion. As Rob Nelson of the Independence Institute rightly noted in 2018, an invasion to the Framers of the U.S. Constitution was defined merely as a “Hostile entrance upon the rights or possessions of another, hostile encroachments.” 

The surge in illegal immigration since Joe Biden was sworn in as president are, to say the least, hostile encroachments upon the sovereignty of the United States. These groups of undocumented persons bring with them an assortment of communicable diseases, criminality, illicit narcotics, firearms, and other things that certainly threaten the rights and possessions of American citizens. 

Under the Guarantee Clause, therefore, President Biden is duty-bound to use all measures to repel this ongoing invasion and strengthen America’s porous borders.

Democrats would argue that President Biden is doing just that: he’s deploying 1,500 active-duty US military personnel to the Southwestern border along with large numbers of officers from various federal agencies, such as the United States Secret Service and the Drug Enforcement Administration (DEA). 

Yet, these numbers are much smaller than the massive scale of human beings who are charging toward our broken border. Further, the contingent of military and federal forces being deployed in response to the invasion are not being given operational control—let alone authority—to do more than passively watch as the border is overrun. 

They lack the numbers, resources, and mission to effectively defend our border. 

Biden is Shirking his Constitutional Duties

Thus, the case that President Biden and his supporters are making, that they are doing everything in their power to stop the invasion of illegal immigrants from Latin America, doesn’t hold up under scrutiny. 

Biden is doing the least amount he can to stop this movement of undocumented persons whose intentions are mostly unknown. Congress has already floated the idea of impeaching Secretary of Homeland Security Alejandro Mayorkas for presiding over the debacle at America’s border. 

But that is insufficient. 

Mayorkas is merely a player in the Biden scheme along America’s exposed Southwestern border. The White House is driving this policy. At the very least, they’re not commanding their lax secretary of Homeland Security to do his job and make the homeland more secure. Congress needs to pursue Biden with impeachment for dereliction of his constitutional duty—under the Guarantee Clause—along the border. 

Of course, the House GOP won’t do that. 

This is primarily because they likely don’t have the votes. Even if they did have the votes in the United States House of Representatives (they don’t), the United States Senate certainly won’t go for it. 

But Congress had all the time and energy to impeach former President Donald J. Trump for an overblown phone call to the Ukrainian president in 2019 and to pursue Trump over fabricated claims that the forty-fifth president was a Russian spy. 

Unlike those non-scandals during Trump’s presidency which stunted Trump’s ability to lead, weakened America, and divided our people needlessly, the scandal at the Southwestern border is harmful to millions of people and makes the United States vulnerable. 

After all, it isn’t only economic migrants breaking into the United States. 

Thousands of undocumented Chinese citizens have entered the United States through our broken border. As have Hezbollah, ISIS, and al Qaeda terrorists. Any of which might be smuggling weapons of mass destruction (WMD) into America or plotting a wave of terrorist attacks. That might sound over-the-top and terrifying, but history tells us such things can happen. 

Biden’s failure at the border is more than just another (of many) political scandals. It is a breach of his constitutional duties as president. 

He should be punished accordingly. 

Even if they don’t have the votes, on this issue, given the seriousness of it, why can’t the House GOP push articles of impeachment—if only to highlight to the American people how dangerous the situation at the border really is?
